NARRATIVE

The Board of Visitors of The College of William and Mary is bound by the laws of the Commonwealth of Virginia. The Preamble to the Bylaws of The College of William and Mary Board of Visitors states, "In executing its duties, the Board will be guided by the laws and policies of the Commonwealth of Virginia."

Members of the Board of Visitors of The College of William and Mary are appointed by the Governor and approved by the General Assembly. Those proposed for membership on Boards of Visitors are screened by an Advisory Commission and the staffs of the offices of the Governor and General Assembly. Their screening includes checking on conflicts of interest. The Commonwealth of Virginia has a conflict of interest statute that applies to members of Boards of Visitors. It is contained in Code of Virginia, Section 2.2-3100 which states, "…the citizens are entitled to be assured that the judgment of public officers and employees will be guided by a law that defines and prohibits inappropriate conflicts and requires disclosure of economic interests. To that end for the purpose of establishing a single body of law applicable to all state and local government officers and employees on the subject of conflict of interests, the General Assembly enacts this State and Local Government Conflict of Interests Act so that the standards of conduct for such officers and employees may be uniform throughout the Commonwealth."

Code of Virginia, Statute 2.2-3114, Section B, requires all members of boards of visitors in the Commonwealth of Virginia to file an annual conflict of interest disclosure form with the Office of the Secretary of the Commonwealth. The “Financial Disclosure Form” is to be completed and returned by January 15th of each year. The form asks filers to list their financial interests, personal interests, offices and salaried employments, business and service interests, compensations for expenses and real estate holdings. These forms are filed and maintained as public records for five years in the Office of the Secretary of the Commonwealth.
