JUDGMENT OF COMPLIANCE
NARRATIVE
The seventeen members of the Board of Visitors of The College of William and Mary are appointed by and accountable to the Governor of the Commonwealth of Virginia. Policies whereby members can be dismissed only for appropriate reasons and by a fair process are contained in the following Code of Virginia items:
Statute 23-49.27 of the Code of Virginia directs the board, “If any visitor fails to perform the duties of his office for one year without sufficient cause shown to the board, the board of visitors shall, at its next meeting after the end of such year, cause the fact of such failure to be recorded in the minutes of its proceedings, and certify the same to the Governor. The office of such visitor shall be vacated.”
Statute 2.2-108 of the Code of Virginia gives the Governor the power to dismiss board members for appropriate reasons, “…the Governor may remove from office for malfeasance, misfeasance, incompetence, or gross neglect of duty any member of the board of any public institution of higher education in Virginia.” The statute also provides that, “The Governor shall set forth in a written public statement his reasons for removing any member pursuant to this section at the time the removal occurs. The Governor shall be the sole judge of the sufficiency of the cause for removal as set forth in this section.”
The minutes of the Board of Visitors of The College of William and Mary show that no member of the Board has been dismissed in recent memory, but these statutes assure that a dismissal of a board member would be appropriate and fair. Copies of the minutes for the Board of Visitors of The College of William and Mary are kept at Richard Bland College in the President’s Office. Minutes for the last six years are also available online through The College of William and Mary website.
