Appendix 3: Definitions
IN THIS SECTION:
The terms “Code of Conduct”, “Student Code of Conduct”, and “Standard Code of Conduct” are used interchangeably.
- “College” means Richard Bland College of William & Mary.
- “Student” includes all persons taking courses at the College, either full-time or part-time, pursuing undergraduate degrees or non-degree seeking students, including dual enrollment. Persons who withdraw after allegedly violating the Standards of Conduct, who are not officially enrolled for a particular term but who have a continuing relationship with the College, or who have applied for admission to the College are considered “students.” These Standards of Conduct apply at all College locations.
- “Faculty member” means any person hired by the College to conduct classroom or teaching activities or who is otherwise considered by the College to be a member of its faculty.
- “College official” includes any person employed by the College performing assigned administrative or professional responsibilities.
- “Member of the College community” includes any person who is a student, faculty member, administrator, or any other person employed by the College. The President or designee will determine a person’s status in any particular situation.
- “College property” includes all land, buildings, facilities, and other property in the possession of or owned, used, leased, licensed, or controlled by the College (including adjacent streets and sidewalks).
- “Organization” means any number of persons who have complied with the formal requirements for College recognition.
- “Student Conduct Board” means any person or persons authorized by the President to determine whether a student has violated the Standards of Conduct or Honor Code and to impose sanctions when a violation has been determined.
- “Will” and “Shall” are used in the imperative sense.
- “May” is used in the permissive sense.
- An “attempt” is any act beyond mere preparation carried out with the intent to engage in conduct that violates College policies. Attempted violations may be sanctioned in the same manner as completed violations.
- “A preponderance standard, preponderance of the evidence, or preponderance of the facts” exists when a reasonable person, after a careful balancing of available information, would conclude a violation has occurred and the student/organization charged is responsible for the violation.
- “Policy” means any written regulations of the College as found in, but not limited to, the Student Handbook, Residence Life Housing Agreement, the College website, Computer Use Policy, and College Catalog.
- “Reporting Party” means any person who submits a charge alleging that a student violated the Standards of Conduct or Honor Code.
- “Respondent” means any student or student organization alleged to have violated the Standards of Conduct or Honor Code.
- “Working days” means any day that the College is open for business exclusive of weekends or official holidays.
- “Consultant/Counsel” is the person a respondent may bring to a hearing for consultation or from whom the respondent may seek advice about information provided or questions asked during a hearing. This person could be an attorney if the respondent is facing criminal/civil action outside of the institution’s hearing for the purpose of advice on questions that may be self-incriminating. This person is not to argue, advocate, or present information on behalf of the respondent but only serves to help the respondent feel comfortable and to provide advice on how to behave during a hearing.
- Campus police means sworn personnel within the Department of Campus Safety & Police.
